Sec. 40-94.1. l~.uforcement and guarantee of performance and conditions. <br /> <br /> The planning director may require the petitioner of the zoning amendment, his <br />successor or his contractor, to guarantee performance of the conditions approved <br />by council in an amount and in a manner satisfactory to the city council. Such <br />guarantee shall be reduced or released by the city council or its agent upon the <br />submission of satisfactory evidence that performance of such conditions has been <br />completed in whole or in part. <br /> <br /> Failure to meet all conditions approved by city council, including the guarantee <br />herein provided, shall constitute cause to deny the issuance of any of the required <br />use, occupancy or building permits. <br /> <br /> The zoning administrator, in an effort to enforce the conditions approved by city <br />council under authority, herein, may: <br /> <br />(a) Bring necessary legal action to insure compliance, including injunction, <br /> abatement or other appropriate legal relief; and <br /> <br />(b) Order in writing the remedy for any noncompliance of conditions. <br /> <br />Sec. 40-94.2. Records of conditions. <br /> <br /> The zoning maps will show by an appropriate symbol the existence of conditions <br />attached to the conditional zoning. The zoning administrator shall keep in his office, <br />and make available for public inspection, a conditional zoning index. The index shall <br />provide ready access to the ordinance creating conditions in addition to the <br />regulation provided for in the particular zoning district or zone. <br /> <br />Sec. 40-94.3. Amendments and variations of conditions. <br /> <br /> There shall be no amendment or variation of conditions created pursuant to the <br />provisions of Seetion 40-94 herein until after a public hearing before the city council <br />advertised pursuant to the provisions of the Code of Virginia. <br /> <br />Sec. 40-94.4. Petition for review of decision. <br /> <br /> Any zoning applicant or any other person who is aggrieved by a decision of the <br />building official made pursuant to the provisions herein, may petition the city council <br />for the review of the decision of the zoning administrator. Ail such petitions for <br />review shall be filed with the building official and with the clerk of the city council <br />within (30) thirty days from the date of the decision for which review is sought, and <br />such petitions slmll specify the grounds upon which the petitioner is aggrieved. <br /> <br />Sec. 40-95 - 40-100.
