ARTICLE VII. AMEND~T AND REZONINGS <br /> <br />Sec. 40-91. Amendment and rezoning. <br /> <br /> Sections of the Code may be amended from time to time. Such amendments may <br />include the number, shape, boundaries, area or requirements of any zoning district <br />or area, and creation of new districts and areas. <br /> Amendments and rezoning requests may be initiated by the city council, or the <br />planning commission of the City of Portsmouth, one or more owners, contract <br />purchasers who have obtained the property owner's written consenT, or agents of <br />the property owner. <br /> <br />Sec. 40-9!.1. Amendment and rezonin~ application procedure. <br /> A petition to amend or change the district boundaries or regulations herein or <br />subsequently established shall be filed with the planning director. <br /> Such a petition shall be on such form and shall contain such information as is <br />required by this Article and be accompanied by such fee as is required by Article <br />XII. <br /> <br /> An application for any review under this Article shall be submitted in such form, <br />number of copies and format as required by the planning director and together with <br />such fees as required in Article XII. <br /> <br />Sec. 40-91.2. Action by planning director. <br /> <br /> (a) Upon receiving a complete petition, the planning director shall cause legal <br /> notice of a public hearing to be published in the manner required by the <br /> Code of Virginia. <br /> <br /> (b) The planning director shall analyze the petition, prepare any necessary <br /> study maps and present the petition, together with recommendations <br /> thereon, if any, to the planning commission at its next meeting when such <br /> petitions are to be considered. <br /> <br /> (c) On or before the date legal notice is published, the planning director shall <br /> cause one or more signs to be posted upon the premises involved in the <br /> proposed amendment. Signs shall be posted at such place or places as, in <br /> the director's opinion, will afford notice to owners and residents of adjacent · <br /> properties. Such signs shall state the present and proposed zoning <br /> classifications and the time and place of the public hearing to be held by the <br /> planning commission. Failure to post such signs shall not invalidate any <br /> otherwise lawful zoning amendment. <br /> <br /> (d) When a proposed amendment involves a change in zoning classification of <br /> twenty-five (25) or fewer parcels of land, then, in addition to the <br /> <br />102 <br /> <br /> <br />
