advertising as above required, written notice in a manner required by the <br />Code of Virginia shall be given by the planning director at least five (5) <br />days before the hearing to the owner or owners, or their agent or the <br />occupant, of each parcel involved, and to the owner or owners, their agent <br />or occupant, of all abutting property and property immediately across the <br />street or road from the property affected. When a proposed amendment <br />involves a change in the zoning classification of more than twenty-five (25) <br />but fewer than five hundred (500) parcels of land, then, in addition to the <br />advertising as required above, written notice in the manner required by the <br />Code of Virginia shall be given by the planning director at least five (5) <br />days before the hearing to the owner or owners, or their agent, of each <br />parcel of land involved. <br /> <br />Sec. 40-91.3. Plarmlng commission action. <br /> <br /> Upon consideration of any motion or petition for amendment or rezoning, after <br />public hearing, if held, and action in open meeting, the planning ommission shall <br />submit its recommendation thereon, with its reasons for the same, to the city <br />council. Where any such recommendation shall involve an amendment of the zoning <br />map, such recommendation shall have attached thereto a draft of the ordinance to <br />accomplish such amendment, such ordinance to be in such form as may be required <br />by the city attorney. <br /> <br />See. 40-91.4. City clerk action. <br /> <br /> The city clerk shall give legal notice of the proposed zoning amendment as <br />required by general law and place the item on the agenda of the next city council <br />meeting at which the same may be considered. Reference in the minutes of council <br />meetings to the name of the applicant and the petition for zoning amendment number <br />assigned by the planning eemmission for the zoning amendment ordinance number <br />(which shall be the same as the petition for zoning amendment number) shall be <br />sufficient identification of the property and matters therein mentioned. Upon final <br />passage of any zoning amendment ordinance, the city clerk shall record the same in <br />a separate ordinance book provided therefor. <br /> <br />Sec. 40-91.5. Limitation on petitions. <br /> <br /> No petition for rezoning shall be accepted by the planning director within one year <br />of final action by the city eouncli upon a prior petition concerning a zoning change <br />involving any or all of the same parcel of land; however, this shall not restrict the <br />authority of the city council or planning commission to initiate a rezoning of any <br />property. <br /> <br />See. 40-92~ Petitions for rezonlng. <br /> <br /> An application for a rezo.~ing or a zoning map amendment which is to be subject to <br />certain conditions shall contain an express, written request setting forth each <br />condition desired in accordance with the Code of Virginia. <br /> <br />103 <br /> <br /> <br />
