(b) <br /> <br />(c) <br /> <br />for each 400 square feet of gross floor area; <br /> <br />However, upon application, the planning commission may, at a regular <br />monthly- meeting, grant a special exception. The commission shall take into <br />the account the relationship of the zone lot involved to other spaces and <br />structures located in, or proposed for, this zoning district in arriving at its <br />recommendation and may cite comprehensive plan elements relative thereto. <br /> <br />Notwithstanding any other provisions of this chapter, whenever (i) there <br />exists a lot with one or more structures on it constructed before the <br />effective date of this chapter, and (ii) a change in use that does not involve <br />any enlargement of a structure is proposed for such lot, and (iii) the <br />parking requirements of this section that would be applicable as a result of <br />the proposed change cannot be satisfied on such lot because there is not <br />sufficient area available on the lot that can practicably be used for parking, <br />then the developer need only comply with the requirements of this section <br />to the extent that (i) parking space is practicably available on the lot where <br />the development is located, and (ii) off-site parking space is reasonably <br />available as provided in Section 40-4§. <br /> <br />Sec. 40-57. Certificate of intent. <br /> <br /> Upon application of a property owner, the downtown design committee shall confer <br />with the applicant and consider the approval of a certificate of intent for a proposed <br />project, which certificate shall contain specifications for use, building, height, <br />bulk, location (with setback requirements), required number of parking spaces, <br />landscaping requirements, signs and other design features to be incorporated. The <br />certificate of intent shall be valid for one year from the date of issuance. <br /> <br /> An application for a certificate of intent or a certificate of compliance from the <br />committee shall contain the same information required by Section 40-53.1 for an <br />application for review by a commission of architectural review in the historic <br />districts. <br /> <br />Sec. 40-57.1. Certificate of compliance. <br /> <br />(a) <br /> <br />REVIEW. Upon receipt of a complete application for a certificate of <br />core-Hence, the committee shall confer with the applicant and shall advise, <br />approve or disapprove such plans and specifications and, if approved, shall <br />issue a certificate of compliance therefore witl~ or without conditions, or <br />with such modifications of the plans and specifications as the committee <br />deems necessary to fulfill the purposes and objectives of the plan and the <br />design guidelines and to require compliance with the restrictions and <br />conditions of the certificate of intent for the proposed project. Otherwise, <br />the committee shall reject such plans and specifications and shall not issue <br />the certificate of compliance. <br /> <br />(b) <br /> <br />FAILURE TO ACT. The failure of the committee to approve or disapprove <br />such plans and specifications, with or without conditions or modifications, <br />within sixty (60) days from the date of application for the certificate of <br /> <br />84 <br /> <br /> <br />
