kept on same at all times, except when the receptacle is being <br />filled or emptied. Plastic or polyethylene bags shall be used <br />only as liners in such receptacles and it shall be unlawful to <br />use same as the sole means of storage of garbage or refuse on <br />any premises within the city. <br /> <br /> 3. That Section 16-32 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 16-32. Type of container required. <br /> <br /> (a) Except as provided for in paragraph b herein, it <br />shall be unlawful for any garbage or trash to be set upon the <br />streets of the city for collection by the city unless the same <br />is placed in properly sealed plastic or polyethylene refuse <br />bags that meet or surpass the minimum standards of the <br />National Sanitation Foundation, or in a r~gid, tapered, <br />galvanized steel or plastic receptacle, of not less than ten <br />(10) nor more than thirty-two (32) gallons' capacity and no <br />more than seventy (70) pounds total weight. Such receptacles <br />shall be covered by a tight-fitting cover of substantial <br />plastic or galvanized steel. Both plastic and galvanized <br />receptacles shall have two (2) secure handles for lifting and <br />emptying. <br /> <br /> (b) For residences receiving automated refuse collection <br />it shall be unlawful for garbage or trash to be set upon the <br />streets unless the same is placed in a 65 or 105 gallon <br />container furnished by the city. <br /> <br /> (c) In areas receiving automated refuse collection, as <br />defined in Section 16-1, yard waste must be set upon the <br />streets of the city fog collection placed in clear plastic <br />bags. Such bags must not exceed 40 gallons or 25 pounds each. <br />Customers shall not mix any o~er form of trash, refuse, or <br />garbage with yard waste. Yard :waste too bulky to be placed in <br />clear plastic bags shall be included for collection as bulk <br />refuse. <br /> <br /> 4. That Section 16-33 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 16-33. Substances permitted in containers. <br /> <br /> No substance other than garbage, trash, or yard waste- <br />shall be placed in the refuse bags or receptacles required by <br />Section 16-32. <br /> <br /> 5. That Section 16-34(c) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br /> <br />
