1992-14 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 16-1, 16-6, <br />16-32, 16-33, 16-34(c), 16-36(b) AND (c), 16-63, 16-65, and <br />16-71, THEREOF, AND BY ADDING SECTION 16-40 THERETO, <br />PERTAINING TO REFUSE COLLECTION. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 16-1 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding the <br />definitions "Automated refuse collection" and "Yard waste" to <br />read as follows: <br /> <br />Section 16-1. <br /> <br />Definitions. <br /> <br /> Automated refuse collection: The term "automated refuse <br />collection" shall mean collection service provided to <br />residences equipped with a city furnished 65 or 105 gallon <br />automated collection container. <br /> <br /> Yard waste: The term "yard waste" shall mean material <br />derived from leaves, shrubbery trimmings, and lawn trimmings. <br /> <br /> 2. That Section 16-6 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 16-6. <br /> <br />Storage containers generally. <br /> <br /> (a) Except as provided for in paragraph b herein, it <br />shall be unlawful for garbage or trash to be placed, deposited <br />or allowed to remain on any pr~mises within the city unless <br />same is placed or~ kept in a rfgid, tapered, galvanized steel <br />or plastic receptacle of not less than ten (10) nor more than <br />thirty-two (32) gallons' capacity and no more than seventy <br />(70) pounds total weight, which receptacle is covered by a <br />tight-fitting cover of galvanized steel or substantial <br />plastic, respectively, and which receptacle has two (2) secure <br />handles for lifting and emptying. The cover on such <br />receptacle shall be kept on same at all times, except when the <br />receptacle is being filled or emptied. Plastic or <br />polyethylene bags shall be used only as liners in such <br />receptacles and it shall be unlawful to use same as the sole <br />means of storage of garbage or refuse on any premises withfn <br />the city. <br /> <br /> (b) For residences receiving automated refuse collection <br />it shall be unlawful for Garbage and trash to be placed, <br />deposited or allowed to remain on any premises within the c~ty <br />unless same is placed in a 65 or 105 Gallon container <br />furnished by the city.
