1992-82 AN ORDINANCE CLOSING A PORTION OF AN ALLEY BETWEEN FLORIDA AVENUE AND MT. VERNON AVENUE. WHEREAS, Earl Industries, Inc. has made application vacate, close and discontinue the hereinafter described portion of an alley between Florida Avenue and Mt. Vernon Avenue. to WHEREAS, by resolution of this Council adopted August 11, 1992, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said alley and to report in writing whether in their opinion any, and if any what, inconvenience would result from discontinuing said portion of an alley between Florida Avenue and Mt. Vernon Avenue. WHEREAS, the said viewers have reported in writing in their opinion no inconvenience would result from the closing and discontinuing of sai~ alley. that NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter described portion of an alley between Florida Avenue and Mt. Vernon Avenue be closed and vacated as a public alley. Ail that unnamed street, alley or right-of-way located on tax plate 154 and running north and south and between and parallel to Florida Avenue and Mt. Vernon Avenue and perpendicular to and opening onto Commerce Street and Portland Street. BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves unto itself a perpetual easement, rights and privileges to install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers, water mains, storm drains, electric power lines, over, under and across the hereinabove described portion of an alley between Florida Avenue and Mt. Vernon Avenue. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held October 13, 1992. Teste: City Clerk
