To establish ground rules for procedures for <br />hearing appeals from determinations of the City's <br />EEO Coordinator, requests or suggestions from or on <br />behalf of disabled persons regarding access to and <br />the participation in public facilities, services, <br />activities and functions in the community and any <br />other reasonable rules for the conduct of its <br />business. <br /> <br />The Commission shall hear such appeals in public, <br />after adequate public notice. Such decisions and/or <br />determinations of the Commission shall be in Writing <br />and shall be made within twenty (20) days of the <br />hearing. <br /> <br />The Commission shall choose annually one of its <br />members to be chairman for a term of one (1) year <br />and to so serve until a successor is chosen and <br />qualifies. <br /> <br />e <br /> <br />The Commission shall keep a record of all of its <br />proceedings which shall be a public record. <br /> <br />6. The Commission shall serve without compensation. <br /> <br />In the event that the complainant wishes to appeal <br />the Commission's decision, the Commission shall <br />forward the record of its decision and/or <br />determination, to the Council of the City of <br />Portsmouth, Virginia, within ten (10) days of <br />receiving complainants' Notice of Appeal. <br /> <br />Perform such other duties and functions as may be <br />assigned by the City Council. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of <br />Portsmouth, Virginia, shall hear the appeals from the <br />Americans with Disabilities Commission at open and public <br />meetings and shall make its determination, which shall be <br />final, and in writing within thirty (30) days of hearing the <br />appeal. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held September 22, 1§92. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
