A RESOLUTION ESTABLISHING AN AMERICANS WITH DISABILITIES <br />COMMISSION. <br /> <br /> WHEREAS, the Americans With Disabilities Act was signed <br />into law by the President of the United States in 1990; and <br /> <br /> WHEREAS, this federal legislation was enacted to ensure <br />that individuals with disabilities receive equal employment <br />opportunities and other services on an equal basis as that of <br />non-disabled persons; and <br /> <br /> WHEREAS, this legislation requires public entities that <br />employ fifty (50) or more persons to establish a grievance <br />procedure for resolution of complaints from the public <br />pertaining to discrimination on the basis of disability by a <br />public entity; and <br /> <br /> WHEREASt the City of Portsmouth is a public entity and <br />does employ more than fifty (50) persons. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsmouth, Virginia, hereby establishes an Americans <br />with Disabilities Commission consisting of seven members who <br />shall be appointed for three year terms; provided however, <br />that of those persons first appointed, three (3) shall be <br />appointed for three (3) years, two (2) shall be appointed for <br />two (2) years, and two (2) shall be appointed for one (1) <br />year. Additionally, the membership shall be represented as <br />follows: one member each shall be from the business <br />community, the medical community, and the educational <br />community; one member shall be a representative from a <br />non-profit organization; two members shall be disabled <br />individuals; and one member shall be either a resident, <br />property or business owner within the City or shall be <br />employed in the City. The City's ADA Coordinator shall be the <br />liaison to this Commission and shall attend the meetings of <br />the Commission. <br /> <br /> BE IT FURTHER RESOLVED that this Council may remove any <br />member of this Commission for inefficiency, neglect of duty, <br />misfeasance, or malfeasance in office. Any vacancy in the <br />membership of this Commission shall be filled by the City <br />Council for the unexpired portion of the term. <br /> <br /> BE IT FURTHER RESOLVED that the Americans with <br />Disabilities Commission shall have as its functions <br />f61towing responsibilities: <br /> <br />the <br /> <br />1.
