93 <br /> <br />A RESOLUTION RECOGNIZING THE CONCERNS OF THE U.S. FISH AND <br />WILDLIFE SERVICE IN REGARD TO THE ROUTE OF THE CITY OF <br />PORTSMOUTH'S WATER TRANSMISSION LINE TO BE INSTALLED IN SUFFOLK, <br />VIRGINIA. <br /> <br /> WHEREAS, the City of Portsmouth has made application to the <br />U.S. Army Corps of Engineers for a permit (Permit application <br />CENAO-CO-R 92-0004-5) to install a water transmission line in <br />Suffolk,.Virginia; and <br /> <br /> WHEREAS, the U.S. Fish and Wildlife Service has expressed <br />concerns for an endangered species known as a Dismal Swamp <br />'Southeastern Shrew (Sorex longirostris fisherii) hereinafter <br /> referred to as "shrew"; and <br /> <br /> WI{EREAS, the City of portsmouth recognizes the concerns of <br />the U.S. Fish and Wildlife Service; and <br /> <br /> WHEREAS, the final Biological Opinion will be a condition <br />of the Army Corps of Engineers Nationwide Permit 12 and failure <br />to ensure successful mitigation will violate the permit for <br />pipeline construction. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City of Portsmouth will follow <br />the final guidelines set forth by the U.S. Fish and Wildlife <br />Service in their Biological Opinion by ensuring that: <br /> <br />A mitigation plan will be submitted by the City to the <br />Fish and Wildlife Service within three (3) months of <br />the issuance of the Corps of Engineers permit; and <br /> <br />No water may be transported through the transmission <br />line until the mitigation plan has been approved by <br />the Fish and Wildlife Service and has been completed <br />by the City. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia~ <br />at a meeting held October 13, 1992. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
