AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 40-61.2 AND 40-61.5 ~ND TABLES 40-61.1-1 AND 40-61.1-2 THEREOF, PERTAINING TO SIGNS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-61.2 of the Code of the City of Portsmouth, Virginia, 1988, be amended by renumbering as Condition (1.1) canopy signs, that was previously numbered Condition (14) and by adding thereto Conditions( 9.1) portable signs and (11.1) temporary signs to read as follows: (1.1) CANOPY SIGNS. The advertising display area shall be confined to the vertical surface of any canopy or awning and shall consist only of the name and/or logo of the business or institution sewn, painted, stenciled or otherwise placed on the surface. Canopy signs for certain institutional uses are permitted in all zoning districts subject to Section 40-61.7. (9.1) PORTABLE SIGNS shall include: (i) any sign not permanently attached to the ground or to a permanent structure; (ii) any sign designed to be transported, including, but not limited to, a sign designed to be transported by means of wheels; (iii) any sign with chassis or support construction without wheels; (iv) any sign converted to or constructed as A-frame or a T-frame except as permitted in Condition (ll.1)(ii); or an (ll.1) (v) any sign attached to or painted on a motor vehicle parked and visible from the public right-of-way, where said motor vehicle is left in the same area for a length of time in excess of 60 days so that said motor vehicle has ceased to be used as a means of transportation in the normal operation of the business. TEMPORARY SIGNS. A temporary sign or displa~ is a sign constructed of cloth, canvas, fabric, paper, plywood or other light materials. There shall be no more than one temporary sign per esuablishment per zone lot.
