Commission and the Virginia Motor Vehicle Safety <br />Responsibility Act. Both the owner and the driver shall <br />furnish proof deemed sufficient to the City Manager prior to <br />the issuance of any license, charter, certificate or permit <br />required by the city code and at such times and places as the <br />City Manager or his duly authorized agent may require and on <br />an annual basis at the time of the renewal of such insurance° <br /> <br />Section 37-29. General vehicle requirements. <br /> <br /> (a) Public vehicles shall be of the enclosed or sedan <br />type or a station wagon with at least four (4) doors and not <br />less than five-passenger capacity. <br /> <br /> (b) Every public vehicle operated within the City shall <br />meet all requirements of state law and this Code and other <br />ordinances of the City as to lights, brakes, horn and <br />inspection, and must be kept in a good, clean, neat and safe <br />condition and appearance. It shall be the duty of the Chief <br />of Police to make random inspections of public vehicles for <br />compliance with this subsection and report all findings to the <br />City Manager. <br /> <br />Section 37-32. Number of passengers. <br /> <br /> No public vehicle shall be used to transport more than <br />five (5) passengers; provided, however, that the provisions of <br />this section shall not apply to small children. <br /> <br />Section 37-35. Transportation of alcoholic beverages. <br /> <br /> It shall be unlawful for any person to use any public <br />vehicle operated pursuant to this article to transport <br />alcoholic beverages, except when carried in the possession of <br />a passenger who is being transported for compensation at the <br />regular rate charged other passengers. Any person who <br />violates or fails to comply with the provisions of this <br />section shall be guilty of a Class 1 misdemeanor. <br /> <br />Section 37-36. <br /> <br />Drivers bearing evidence of intoxicating <br />beverages. <br /> <br /> No owner or operator of a public vehicle shall permit any <br />driver to work if he reports for duty with any evidence of <br />intoxicating beverages on his person or upon his breath~ Any <br />person who violates or fails to comply with the provisions of <br />this section shall be guilty of a Class 1 misdemeanor. <br /> <br /> <br />
