AN ORDINANCE TO A~END CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY A~ENDING SECTIONS 30-116[c) 30-236(c) T~EREOF, PERTAINING TO RETIREMENT SYSTEMS. BE IT ORDAINED by the Council of the City of Portsmouth~ Virginia: 1. That Sections the City of Portsmouth, follows: 30-116[c) and 30-236[c) of the Code of Virginia (1988), be amended uo read as Sec. 30-116. Service retirement. (c) Any member who nerminates service as an employee prior to retirement and who complies with one (1) of the requirements sen forth in subsections (1), (2), (3), (4) or (5) below, and who has attained the age of sixty (60), may retire at any time then or thereafter under the provision of subsection (a) of this section. If such member shall have terminated service prior to July 1, 1994, he shall receive a retirement allowance calculated on the basis of the benefits in effect on the date of his termination of service. (1) The member terminated prior to July 1, 1973, but after the attainment of age fifty (50) and the completion of twenty (20) years of creditable service; or (2) The member terminated after June 30, 1973, and after the completion of ten (10) years of creditable service; or (3) Membership began before July 1, 1977 and the member terminated after June 30, 1974 and after the completion of five (5) years of creditable service; or (4) Membership began after June 30, 1977, and termination occurred after the completion of ten (10) years of creditable service. (5) Membership began after June 30, 1991, and termination occurred after the completion of five (5) years of creditable service. Provided, however, that no such member shall be entitled to the benefits of this subsection (c) if his supervisor certifies that his service was terminated because of dishonesty, malfeasance, or misfeasance in office. Such certification may be appealed to the board, and its decision shall be final.
