Sec. 30-236(¢). Service retirement. (c) Any member who ~erminates service as an employee prior to retlremen5 and who complies with one (1) of the requirements set forth in subsections (1), (2), (3) ~ (4) or (5) below, and who has annained the age of sixty (60), may retire at any time then or thereafter under the provisions of paragraph ~a) of this section If such member shall have terminated service prior no July 1, 1994, he shall receive a retirement allowance calculated on the basis of the benefits in effect on the dane of his termination of service. (1) The member nerminated prior to July 1, 1973, but after the attainment of age fifty (50) and the completion of twenty (20) years of creditable service; or (2) The member terminated after June 30, 1973, and after the completion of men (10) of creditable service; or years (3) Membership began before July 1, 1977, and the member terminated after June 30, 1975, and after the completion of five (5) years of creditable service; or (4) Membership began after June 30, 1977, and termination occurred after nhe completion of ten (10) years of creditable service; or (5) Membership began after June 30, 1991, termination occurred after the completion of five (5) years of creditable service. and Provided, however, that no such member shall be entitled to the benefits of this subsection (c) if his supervisor certifies that his service was terminated because of dishonesty, malfeasance or misfeasance in office. Such certification may be appealed to the board, and its decision shall be final. 2. That this ordinance shall take effect on the date of its adoption.
