AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTIONS 24-208, <br />24-259 AND 24-317 (c), PERTAINING TO SWEARING, PUBLIC <br />DRUNKENNESS AND TRESPASSING. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth~ <br />Virginia: <br /> <br /> 1. That Sections 24-208, 24-259 and 24-317(c) of the <br />Code of the City of Portsmouth, Virginia (1988), be amended and <br />reordained to read as follows: <br /> <br />Sec. 24-208. Profane swearing. <br /> <br /> If any person profanely curses or swears in public, he <br />shall be guilty of a Class 4 misdemeanor. A person charged <br />with a violation of this section may be tried and convicted in <br />his absence. <br /> <br />Sec. 24-259. Public drunkenness. <br /> <br /> If any person is intoxicated in public, whether such <br />intoxication results from alcohol, narcotic drug, or other <br />intoxicant or drug of whatever nature, he shall be guilty of a <br />Class 4 misdemeanor. A person charged with a violation of this <br />section may be tried and convicted in his absence. <br /> <br />Sec. 24-317. Trespass at night upon church or school property. <br /> <br /> (c) Any person violating the provisions of (i) subsection <br />{a) shall be guilty of a Class 3 misdemeanor and (ii) <br />subsection (b) shall be guilty of a Class 1 misdemeanor. <br /> <br /> 2.
