ORDmAF' <br /> <br />AN ORDINANCE TO AF~ND CHAPTER 36 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 36-3 THEREOF, <br />PERTAINING TO THE SALE OF FLOWERS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 36-3 <br />Portsmouth, Virginia (1988), <br />as follows: <br /> <br />of the Code of the City of <br /> be amended and reordained to read <br /> <br />See. 36-3. Sale of flowers, plants, etc., on streets. <br /> <br /> It shall be unlawful for any person to sell or offer for <br />sale, or have in his possession for the purpose of sale, at any <br />stand or from any box, basket or other'container on the streets <br />of the city any flowers, bulbs, plants, trees or shrubs. This <br />section shall not apply to a person or his agent selling in the <br />residential portions of the city who does not remain stationary <br />at some point for more than five (5) minutes and who either <br />raises on his premises the flowers, bulbs, plants, trees and <br />shrubs offered for sale or pays the necessary license tax for <br />the sale thereof. <br /> <br /> This section shall also not apply to any sidewalk vendor <br />who obtains a permit under Chapter 32, Article VI, of this <br />Code. <br /> <br /> 2.
