disinterested person shall be kept with the animal as required <br />by §3.1-796.105. For purposes of this subsection, a <br />disinterested person shall not include a person releasing or <br />reporting the animal to the facility. During the period of <br />inpoundment, the dog may be redeemed by paying to the attendant <br />at the pound the sum of twelve dollars ($12.00) for the first <br />day and five dollars ($5.00) for each additional day or any <br />part thereof to cover the actual expenses incurred in keeping <br />the dog impounded and by exhibiting to the person in charge of <br />the pound the receipt for the license tax required to be paid <br />by this chapter. All such impounding fees shall be paid over <br />to the city treasurer monthly. <br /> <br /> 2. That Section 4-32 of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to add <br />paragraph (e), as follows: <br /> <br /> (e) Nothing in this section shall prohibit the immediate <br />destruction, delivery to any humane society or shelter, or <br />adoption, as provided in clauses (ii) and (iii) of subsection <br />(c), of an animal who has been delivered voluntarily or <br />released to a pound, animal shelter, animal warden, or humane <br />society by the animal's rightful owner after the rightful owner <br />has, in writing, surrendered all property rights on such animal <br />and has read and signed a statement (i) certifying that no <br />other person has a right of property in the animal and (ii) <br />acknowledging that the animal may be immediately euthanized, <br />delivered to any humane society or shelter, or adopted as <br />provide in clauses (ii) and (iii) of subsection (c). <br /> <br /> 3. That Section 4-33.1 (d) of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec. 4-33.1. Authority to control dangerous or vicious dogs. <br /> <br />(b) .... <br /> <br /> (d) The owner of any animal found by the court to be a <br />dangerous dog shall, within ten (10) days of such finding, <br />obtain a dangerous dog registration certificate from the animal <br />warden for a fee of fifty dollars ($50.00) in addition to other <br />fees that may be authorized by law.
