AN ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTIONS 4-32 (c), AND <br />BY ADDING THERETO SUBSECTION (e), BY AMENDING SECTION 4-33.1 <br />(d) AND BY ADDING THERETO SECTION 4-96 (c), PERTAINING TO <br />Ai~IMALS AND FOWL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 4-32 (c) of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec. 4-32. Impoundment when running at large without leash or <br />muzzle. <br /> <br />(b) .... <br /> <br /> (c) Duration, redemption. Every dog zmpounded pursuant <br />no subsection (a) of this section shall be penned for five (5) <br />days, except that any impounded dog whose owner is identified <br />shall be held for an additional five (5) days. Such period <br />shall commence on the day immediately following the day the dog <br />is initially confined in the Portsmouth Humane Society <br />facility. During the period of impoundment, the dog may be (i) <br />redeemed by the rzghtful owner, (ii) adopted by a resident of <br />the city for which the pound ms operated who will pay the <br />required license fee, if any, on such animal, if the animal's <br />rightful owner has surrendered all properny rights in such <br />animal and has read and szgned a statement as required by <br />subsection (e), or (iii) adopted by a resident of an adjacent <br />political subdivision of the Commonwealth, if the animal's <br />rightful owner has surrendered all property rmght in such <br />animal and has read and sm~ned a snanemenn as required by <br />subsection (e). However, any feral dog non bearing a collar, <br />nag, tannoo, or other form of identification which, based on <br />the the written certification of a disinterested person, <br />exhibits behavior that poses a risk of physical injury to any <br />person confining the animal, may be euthanized after being kept <br />for a period of not less than three days~ an least one of which <br />shall be a full business day, such period to commence on the <br />day the animal ms initially confined in the facility, unless <br />sooner claimed by the rightful owner.
