(f) Violations; additional remedies; injunctions. <br /> <br /> As an additional remedy, the operation or maintenance, or <br />to permit the operation or maintenance of any activity, device, <br />instrument, vehicle or machinery in violation of any provision <br />of this ordinance, which operation or maintenance causes <br />discomfort or annoyance to reasonable persons or which <br />endangers the comfort, repose, health or peace of residents in <br />the area, shall be deemed and is declared to be a public <br />nuisance and may be subject to abatement summarily by a <br />restraining order or injunction issued by a court of competent <br />jurisdiction. <br /> <br />(g) Vibration standards. It is illegal and shall be deemed a <br />Class 4 misdemeanor for a person to cause or allow any <br />operation or engage in any activity causing vibrations to be <br />generated which are greater than the perception threshold at <br />any point outside of the boundary of the property where the <br />source of the vibrations is located. The perception threshold <br />is the minimum vibration motion necessary to cause awareness of <br />the existence of the vibration by direct means, including but <br />not limited to, sensation by touch or visual observations. Any <br />vibration which produces more than five-tenths (0.5) <br />inch/second root mean square vertical velocity shall be deemed <br />sufficient to cause the awareness of the existence of the <br />vibration by direct means~ <br /> <br />(h) Exceptions. To the extent provided in this section the <br />provisions of this ordinance shall not apply to: <br /> <br /> (1) The operation of construction devices, with sound <br />control devices equivalent to or better than the original <br />equipment, used in construction activities during the hours of <br />7:00 a.m. to 8:00 p.m. <br /> <br /> (2) The repair, maintenance or construction of public <br />facilities of the state or municipal governments, or a <br />political subdivision thereof. <br /> <br />(3) Emergency work to repair equipment or facilities. <br /> <br /> (4) The operation of railway equipment and vehicles <br />operated exclusively on rails. <br /> <br />(5) The necessary operation of emergency signal devices. <br /> <br /> <br />
