(b) Every public pool shall have a person 6n premises at <br />all times during periods of operation, who is fully capable of <br />and shall assume responsibility for compliance with all <br />requirements relating to pool operation, maintenance and safety <br />of bathers. <br /> <br /> (c) Routine (e.g., daily and weekly) operating procedures <br />shall be permanently posted in a location accessible to and <br />frequented by the operator. <br /> <br /> (d) Manufacturer's instructions <br />maintenance of mechanical and electrical <br />kept available for the operator. <br /> <br />for operation and <br />equipment shall be <br /> <br />until <br />with. <br /> <br />(e) No public pools shall be used or available for use <br /> all requirements of sections 34-5 and 34-7 are complied <br /> <br />Sec. 34-8. Suspension of public pool permit. <br /> <br /> (a) If the administrative authority finds that the health <br />and safety of those who utilize a public swimming pool is <br />endangered, due to improper operation or continued for flagrant <br />violation, he may order the immediate suspension of the pool's <br />permit until such time as he finds that the danger no longer <br />exists. No person shall operate any public swimming pool when <br />subject to an order of suspension. <br /> <br /> (b) The administrative authority shall notify the owner, <br />in writing, stating the reason(s) for the suspension. The <br />owner shall have the right to appeal the suspension to the <br />administrative authority. However, such appeal shall not <br />affect the order for suspension until such time that the appeal <br />is heard and the order changed. The owner may request a <br />reinspection when the condition(s) causing the suspension has <br />been corrected. Upon compliance with the requirements of this <br />chapter, the suspension shall be removed. <br /> <br /> (c) Any person aggrieved by the refusal to grant, or by <br />the revocation or suspension of the permit of a swimming pool, <br />shall have the right to appeal therefrom to the circuit court <br />of the City of Portsmouth after an administrative hearing. <br /> <br />Sec. 34-9. Violations of provisions governing prosecutions, <br /> notice, etc. <br /> <br /> The provisions of Volume I of the Virginia Uniform <br />Statewide Building Code shall govern the prosecution of <br />violations relating to the design and construction of swimming <br /> <br />5 <br /> <br /> <br />
