A violation of <br />any other provision of this chapter shall constitute a Class 3 <br />misdemeanor and every failure, refusal or neglect to fully and <br />completely comply with the provisions of this chapter and each <br />day's continuance thereof beyond the time specified shall <br />constitute a separate offense. <br /> <br />Sec. 34-10. Pool management companies; duties. <br /> <br /> Ail pool management companies, within ten (10) days after <br />commencing operation of a public pool, shall provide the <br />administrative authority with the names and locations of all <br />public pools they operate in Portsmouth and the names, <br />telephone numbers and addresses of their operating personnel. <br />Such companies shall be responsible for assuring compliance <br />with sections 34-5 and 34-7 of this chapter. <br /> <br />Sec. 34-11. Applicability of chapter to existing pools. <br /> <br /> The structural and equipment provisions and requirements <br />of this chapter shall not apply to any public pool constructed <br />prior to the effective date of this ordinance, except as <br />follows: <br /> <br /> (i) Any alteration,' placement or replacement of any <br />equipment shall comply with such requirements. <br /> <br /> (2) The provisions and requirements of this chapter with <br />respect to operational procedures and standards, chemical <br />feeding equipment, flow meters, pressure gauges and lifeguards <br />shall be complied with by all public swimming pools, regardless <br />of date of construction. <br /> <br /> (3) The administrative authority may grant modifications <br />to any of the provisions of this chapter which are not under <br />the jurisdiction of the Virginia Uniform Statewide Building <br />Code. <br /> <br />Sec. 34-12. Severability clause. <br /> <br /> Should any article, section, subsection, sentence, clause <br />or phrase of this chapter be declared invalid by a court of <br />competent jurisdiction, such decision shall not affect the <br />validity of the chapter in its entirety or of any part thereof <br />other than that so declared to be invalid. <br /> <br /> <br />
