ORDIHANC[ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 9 OF THE CODE OF THE CiTY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 9-26(a)~ 9-34, <br />9-38, 9-40 AND 9-43, AND BY REPEALING SECTIONS 9-3, 9-30, 9-32, <br />9-33, 9-42 A/4D 9-102 THEREOF, PERTAINING TO CEMETERIES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 9-26(a) of the Code of the~City of <br />Portsmouth, Virginia (1988) be amended and reordained to read <br />as follows: <br /> <br />Sec. 9-26. Burial grounds designated. <br /> <br /> (a) The burial ground at Glasgow Street and Port Lane <br />shall be known as "Cedar Grove Cemetery." The burial ground an <br />London Boulevard and Peninsula Avenue shall be known as "Oak <br />Grove Cemetery". The burial grounds adjoining City Park and <br />Clifford Street shall be known as "Olive Branch Cemetery, "and <br />"Olive Branch Annex Cemenery." <br /> <br /> 2. That Sections 9-34, 9-38, <br />of the City of Portsmouth, Virginia <br />reordained to read as follows: <br /> <br />9-40 and 9-43 of the Code <br />(1988) be amended and <br /> <br />Sec. 9-34. Right to use lot; reverter for non-use. <br /> <br /> The person no whom a recempn of purchase has been issued <br />with reference no a lot, half lot, space or section mn a city <br />cemenery or his assignee shall be entitled to the lot, half <br />lot, space or section so paid for, as a burying place for <br />himself or for any person who is a member of his family or one <br />(1) of his descendants or friends. When a lot, half lot or <br />space shall remain without any interment therein for fifty (50) <br />years, and the purchaser or his assignee shall have died or <br />relocated from the city, and no relative is known no reside in <br />the city, the City Council may give notice thereof once a week <br />for four (4) weeks in a newspaper of general circulation in the <br />City. If no relative of the purchaser or his assignees appears <br />within thirty (30) days from the last day of such publications <br />then the lots half lot or space, as the case may be, shall <br />revert no the City. Whether there is such reverter or not~ the <br />City Council may, at any and all times, regulate the interments <br />in the cemeuery, or any parn thereof, as may seem no it proper. <br /> <br />Sec. 9-38. Proof of purchase upon opening of grave. <br /> <br /> The proof of purchase issued with reference co a lot, half <br />lot, space or section in a city cemenery shall be exhibited no <br /> <br /> <br />
