AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING THEREOF SECTION <br />22-395(a), PERTAINING TO RECKLESS DRIVING. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 22-395 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read <br />as follows: <br /> <br />Sec. 22-395. <br /> <br />Same-Penalty for reckless <br />driving under section 22-391, <br />22-392 or 22-393. <br /> <br /> (a) Every person convicted of reckless driving under <br />Section 22-391, 22-392 or 22-393 shall be punished for a Class <br />1 misdemeanor. <br /> <br /> (b) In addition to the penalties for reckless driving <br />prescribed in subsection (a) of this section, if any person is <br />convicted of reckless driving under any section referred to <br />therein, the court may suspend any license issued to such <br />convicted person under articles 1 through 9 of chapter 3 of <br />title 46.2 (§46.2-300 et seq.) of the Code of Virginia for a <br />period of not less than ten (10) days nor more than slx (6) <br />months, and such court shall require the convicted person to <br />surrender his license so suspended to the court where it will <br />be disposed of in accordance with section 22-347 of this <br />chapter. If the person so convicted has not obtained the <br />license required by such chapter, or is a nonresident, the <br />court may direct in the judgmenu of conviction hat such person <br />shall not, for a period of not less than ten (10) days or more <br />than six (6) months as may be prescribed in the judgment, drive <br />or opera5e any motor vehicle in the commonwealth. The court or <br />the clerk of court shall transmit the license to the <br />commissioner of the stase department of motor vehicles along <br />with the repot5 of the conviction required to be sent ~o the <br />department of mouor vehicles. <br /> <br /> (b) When any person is convicted of reckless driving as <br />provided for in section 22-392, in addition to any other <br />penalties provided by law, the driver's license of such person <br />may be suspended by the couru for a period of not less than <br />sixty (60) days nor more than six (6) months. In case of <br />conviction, the court shall order the surrender of the license <br />to the couru where it shall be disposed of in accordance with <br />section 22-347 of uhis chapter° When the conviction is a <br />second conviction which would require revocation under the <br /> <br /> <br />
