paragraph (d), maintain the subject property for a period of <br />one (1) year from the day following the last day of <br />publication, unless and until notified by the property owner, <br />or someone acting on the owner's behalf, in writing, that the <br />property will be maintained by or for the owner, and the <br />director is satisfied that such maintenance is being carried <br />out satisfactorily. Cessation of maintenance by the owner or <br />by the owner's agent during the period of one (1) year as <br />provided herein shall not be cause for the director to <br />re-advertise during such period, and the director may begin or <br />resume the maintenance as provided herein. In any event, <br />notice as provided in subsection (d) must be given each and <br />every year thereafter, if the director determines that it is <br />necessary to continue such maintenance. <br /> <br /> 3. That Section 23-28 of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec, 23-28. Same-Service. <br /> <br /> Except as otherwise provided in subsections (d) and (e) of <br />Section 23-27, service of the notice required to be given under <br />Section 23-27 shall be made by mailing the notice to the last <br />known street or post office address of the person to whom it is <br />directed or by delivery thereof to such person. Proof of so <br />mailing or delivering a notice shall be sufficient evidence <br />that the notice was served and the date of mailing or delivery, <br />as the case may be, shall be the date of service. In the event <br />the street or post office address of the person to whom the <br />notice is directed is unknown, or the notice so mailed is <br />returned undelivered by the postal service, then service of the <br />notice shall be made by posting the notice on the land or <br />premises on which the nuisance exists or on the land or <br />premises abutting the sidewalk, street or alley on which the <br />nuisance exists. Proof of posting the notice shall be <br />sufficient evidence that the notice was served and the date of <br />posting shall be the date of service. <br /> <br /> 4.
