AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 23-27 (a) AND <br />(d), AND 23-28 AND BY ENACTING A NEW SECTION 23-27 (e) THERETO, <br />PERTAINING TO WEEDS AND DEBRIS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That subsections (a) <br />Code of the City of Portsmouth, <br />reordained to read as follows: <br /> <br />and (d) of Section 23-27 of the <br />Virginia (1988) be amended and <br /> <br />Sec. 23-27. Notice to abate-Required; contents. <br /> <br /> (a) Whenever the director finds that weeds exist on any <br />land, alley, sidewalk or street, he shall give notice in <br />writing of the existence of the nuisance no the owner or <br />occupant, or both, or lien holder, of the land on which the <br />nuisance exmsts, or co the owner or occupann, or both, or lien <br />holder, of the land abutting the alley, sidewalk or sEreen on <br />which the nuisance exists, and shall order the owner or <br />occupann, or both, no cue and, when necessary, remove the weeds <br />within such reasonable time as the director shall specify mn <br />the notice; provided, that in no event shall the time allowed <br />be greater than ten (10) days. <br /> <br />(b) (c) .... <br /> <br /> (d) If the director determines that the land referred to <br />mn this section is unoccupied and the owner is not known; or <br />cannot be found, or has failed to respond no notice(s) of <br />violation of this section, then the direcnor may give notice to <br />the owner of such land or premises Eo cause such weeds or <br />debris co be cut, and/or removed from such land or premises <br />within ten (10) days, or the same shall be done by the City, at <br />the expense of the owner. Notice shall be made by publication, <br />for not less than five (5) days, mn any daily newspaper <br />published, or having a general circulation mn the City, and the <br />cost of such publication shall be collected as part of the <br />expense of making such removal. <br /> <br /> 2. That Section 23-27 of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained by <br />adding subsection (e) thereto to read as follows: <br /> <br />Sec. 23-27.
