Ai~ ORDINANCE TO A~END C~IAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING AND RE-ORDAINING <br />SECTIONS 22-88, 22-567, 22-582 (b), 22-583 (a) AND (c), 22-611 <br />(a) (2), (b), (c) and (e), 22-613, 22-616, 22-642 (a), (b) ANI) <br />(c) and (e), 22-643, 22-644, 22-664 (b) (2) ~ (¢) AND 22-666, <br />PERTAINING TO MOTOR VEHICLES ~ TRAFFIC. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 22-88 of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained <br />as follows: <br /> <br />to read <br /> <br />Sec. 22-88. Operation of vehicle without plate, <br /> sticker or decal. <br /> <br />(a)-(b) .... <br /> <br /> (c) Any owner/operator of a motor vehicle, trailer or <br />semi-trailer from another locality shall be required to display <br />on his/her vehicle a valid local decal issued by the locality <br />that is a party to a compact with the City for the Regional <br />Enforcement of Local Motor Vehicle License Requirements; <br />provided that the owner/operator is required by the <br />jurisdiction of situs to obtain and display such license. <br /> <br /> (d) If a motor vehicle is being operated in the City of <br />Portsmouth unlawfully as provided in paragraphs (a) and (c) of <br />this section, tlhen it shall be the duty of the police officer <br />who observes tke violation to issue to the operator a Virginia <br />Uniform Summons for the violation. It shall be the duty of <br />police officers or uniformed employees of the police department <br />whose normal duties include parking enforcement, to attach to <br />an unoccupied vehicle not displaying a license plate, sticker <br />or decal, a notice of the violation of this section. Such <br />summons, or notice shall instruct the owner to report to the <br />City Treasurer or the Police Records Office of the Police <br />Department to pay the penalty or state objection to and intent <br />to contest the notice of violation. Each owner may, within <br />fourteen (14) days of the time when the summons was issued, or <br />when the notice was attached to said vehicle, pay to the City <br />Treasurer or Police Records Office a penalty in the sum of <br />twenty-five dollars ($25.00). Upon receipt of intention to <br />contest, the designated personnel at the Police Records Office <br />of the Police Department shall certify the notice of violation <br />on an appropriate form:to the issuing officer who shall proceed <br />to have the summons issued by the magistrate.
