AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 2-575(b) AND 2-582(b) THEREOF, PERTAINING TO ADMINISTRATION. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 2-575(b) and 2-582(b) be amended to read as follows: Sec. 2-575. General powers and duties. (b) The museum and fine arts commissmon shall: (5) Accept grants, gifts and appropriations from whatsoever source and expend funds uo enrmch the cultural life of the community by the awarding of grants. Sec. 2-582. Acceptance and disposition of art objects; acceptance, expenditure of monetary gifts. (b) The museum and fine ares commIssion shall have the power no accept, administer and expend for granns or operating and capital expenses, funds received as gifts or from whatsoever sources provided, however, that funds received as gifts mn trusn shall be handled mn accordance with the Eerms of such nrust. All procedures for disbursement of funds muse be approved by the Department of Finance. Funds received from sources other than the city shall be accounted for and deposited to the credit of the city for the use of the museum and fine arts commission, except that funds received as gifts in Erust shall be accounted for in a special fund created and maintained for such purpose and designated as the museum and fine arts commission fund. The museum and fine arts commission shall have no authority no enter into any contracn or incur obligations binding upon the city, the cosE of which will exceed the unencumbered cash balance of the aforesaid fund or appropriation at the time when the obligation is incurred. The Commission shall annually reporu all receipEs and disbursements to City Council. 2. That this ordinance shall go into effect on the date of its adoptIon.
