AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 2-575(b) AND <br />2-582(b) THEREOF, PERTAINING TO ADMINISTRATION. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 2-575(b) and 2-582(b) be amended to read <br />as follows: <br /> <br />Sec. 2-575. General powers and duties. <br /> <br />(b) The museum and fine arts commissmon shall: <br /> <br /> (5) Accept grants, gifts and appropriations from <br />whatsoever source and expend funds uo enrmch the cultural life <br />of the community by the awarding of grants. <br /> <br />Sec. <br /> <br />2-582. Acceptance and disposition of art objects; <br /> acceptance, expenditure of monetary gifts. <br /> <br /> (b) The museum and fine ares commIssion shall have the <br />power no accept, administer and expend for granns or operating <br />and capital expenses, funds received as gifts or from <br />whatsoever sources provided, however, that funds received as <br />gifts mn trusn shall be handled mn accordance with the Eerms of <br />such nrust. All procedures for disbursement of funds muse be <br />approved by the Department of Finance. Funds received from <br />sources other than the city shall be accounted for and <br />deposited to the credit of the city for the use of the museum <br />and fine arts commission, except that funds received as gifts <br />in Erust shall be accounted for in a special fund created and <br />maintained for such purpose and designated as the museum and <br />fine arts commission fund. The museum and fine arts commission <br />shall have no authority no enter into any contracn or incur <br />obligations binding upon the city, the cosE of which will <br />exceed the unencumbered cash balance of the aforesaid fund or <br />appropriation at the time when the obligation is incurred. The <br />Commission shall annually reporu all receipEs and disbursements <br />to City Council. <br /> <br /> 2. That this ordinance shall go into effect on the date <br />of its adoptIon. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on October 24, 1995. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
