AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988} BY AMENDING SECTIONS 12-63, <br />12-64(b) (4), 12-182(c), 12-213 AND 12-250(b) AND (g), AND BY <br />REPEALING SECTIONS 12-92 AND 12-152 THEREOF, PERTAINING TO <br />FINANCE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 12-63, 12-64(b) (4), 12-182(c), 12-213 and <br />12-250(b) and (g) of the Code of the City of Portsmouth, <br />Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 12-63. Absences of the Deputy City Manager for Finance. <br /> <br /> Whenever from sickness or other cause, the deputy city <br />manager for finance is absent from his/her office or otherwise <br />not able to perform the duties thereof, the deputy city manager <br />for finance may designate person(s) who shall be authorized to <br />sign whatsoever papers the deputy city manager for finance <br />would be required to sign if present for duty. <br /> <br />Sec. 12-64. General powers and duties. <br /> <br /> (b) The deputy city manager for finance shall have the <br />power and shall be required to: <br /> <br /> (4) Uncollectible taxes and receivables. Write off <br />Uncollectible taxes of whatsoever kind and other uncollectible <br />receivables owed to the city up to the sum of three hundred <br />dollars ($300.00) for each such sums owed; in accordance with <br />the procedures prescribed in Section 58.1-3910 et seq. of the <br />Code of Virginia. <br /> <br />Sec. 12-182. Progress payments and retainage <br /> on construction contracts. <br /> <br /> {c) Any contract issued after January 1, 1990, for the <br />sum of two hundred thousand dollars ($200,000.00) or more for <br />construction of highways, roads, streets, bridges, parking <br />lots, demolition, clearing, grading, excavating, paving, pile <br />driving, miscellaneous drainage structures, and the <br />installation of water, gas, sewer lines and pumping stations <br />where portions of the contract price are to be retained shall <br />include in the bid proposal an option for the contractor to use <br />an escrow account procedure as set out in Section 11-56.1 of <br />the Code of Virginia, for utilization of the retainage funds by <br />so indicating in the bid documents.
