escrow agreement form included in the bid documents and the <br />contract shall be executed and submitted to the city within <br />fifteen (15) calendar days after notification of award of the <br />contract. If the escrow agreement form is not submitted within <br />the fifteen-day period, the contractor shall forfeit his rights <br />to use the escrow account procedure. <br /> <br />Sec. 12-213. Prequalification of bidders or <br /> offerors. <br /> <br /> (a) The purchasing agent is authorized to prequalify <br />bidders or offerors prior to any solicitation of bids or <br />proposals in accordance with the procedure set out in Section <br />11-46B of the Code of Virginia, whether for goods, services, <br />insurance or construction, by requiring prospective bidders or <br />offerors to submit such information as the purchasing agent <br />shall deem appropriate, including samples, financial reports, <br />and references; provided, however, that opportunity to <br />prequalify shall be given to any prospective bidder or offeror <br />who has not been suspended or debarred from bidding or <br />submitting proposals for city contracts. <br /> <br /> (b) The purchasing agent may refuse to prequality any <br />prospective contractor in accordance with the provisions of <br />Section 11-46B of the Code of Virginia, provided that written <br />reason for such refusal to prequalify shall be made a part of <br />the record in each case. The decision of the purchasing agent <br />shall be final. <br /> <br /> (c) Prequalification of a bidder or offeror shall not <br />constitute a conclusive determination that the bidder or <br />offeror is responsible, and such bidder or offeror may be <br />rejected as non-responsible on the basis of subsequently <br />discovered information. <br /> <br /> (d) Failure of a bidder or offeror to prequalify with <br />respect to a given procurement shall not bar the bidder or <br />offeror from seeking prequalification as to future <br />procurements, or from bidding on procurements which do not <br />require prequalification. <br /> <br />Sec. 12-250. Withdrawal of bid due to error. <br /> <br /> (b) The procedure of the bid withdrawal shall be stated <br />as follows in the advertisement for bids: "The bidders shall <br />submit to the purchasing agent his original work papers, <br />documents and materials used in the preparation of the bid <br />within one (1) business day after the date fixed for submission <br />of bids.
