AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40-106.1 <br />THEREOF, PERTAINING TO THE EXPIRATION OF USE PERMITS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-106.1 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained no read <br />as follows: <br /> <br />Sec. 40-106.1. Expiration of use permits. <br /> <br /> If a building permit, certificane of occupancy, <br />commercial reinspection, business license, or any other <br />required authorization or permit for the allowed use is not <br />issued and if the use has non commenced within two (2) years of <br />the effective dane of final city council approval of the use, <br />the use permit shall automatically expire. Prior to, and <br />within three (3) months of the expiration of the permit, if the <br />applicant gives satisfactory evidence that progress is being <br />made toward obtaining the required permits and authorizations <br />and toward commencement of the approved use, the planning <br />commission may granu a one-year extension of the expiration <br />date of the use permit. <br /> <br /> 2.
