A/~ ORDINANCE TO AMEND CHAPTER 31.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 31.1-1, 31.1-2 <br />AND 31.1-51, AND BY ADDING SECTION 31.1-2.1 THEREOF, PERTAINING <br />TO STORMWATER MANAGEMENT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 31.1-!, 31.1-2 and <br />of the City of Portsmouth, Virginia (1988) <br />reordained to read as follows: <br /> <br />31.1-51 of the Code <br />be amended and <br /> <br />Sec. 31.1-1. Definitions. <br /> <br /> For purposes of this chapner, certain words and phrases <br />shall have the meaning ascribed no them by this section: <br /> <br />(a) "Department" means the department of public works. <br /> <br /> (b) "Developed property" means any parcel which conmamns <br />impervious surface area equal to or greater than three hundred <br />(300) square feet or semi-pervious surface area equal to or <br />greater than six hundred (600) square feet, or any combination <br />equal ~o or greater than three hundred (300) square feet. <br /> <br /> (c) "Director" means the director of the department of <br />public works or his designee. <br /> <br /> (d) Exempt properny means any parcel which is owned by <br />any federal, state or local agencies on which said agency <br />provides for maintenance of smorm drainage and stormwater <br />control facilities that drain into United States waters, and <br />any parcel having entirely privately-maintained smorm drainage <br />and smormwater facilities, provided the proper permits for such <br />facilities have been obtained from the Deparmmenu of <br />Environmental Quality, as provided for in Section 15.1-292.4 of <br />the Code of Virginia. <br /> <br /> (e) "Impervious surface area" means surfaces, such as <br />parking lots, sidewalks, driveways and roofs, on or in a lot or <br />parcel of property which prevenn the infiltration of water mnto <br />the earth. <br /> <br /> (f) "Semi-pervious surface area" means surfaces, such as <br />gravel lots or compacted soil, on or mn a lot or parcel of <br />properuy which substantially reduce the tame of infiltration of <br />stormwater into the earth. For purposes of the utility, <br />semi-pervious areas will be counted at one-half the measured <br />area. <br /> <br /> <br />
