hereinafter set forth. No meeting or other activity shall be <br />conducted at any city swimming pool other than that stated in <br />the application for a permit. <br /> <br />Sec. 36-26. Definition. <br /> <br /> As used in this article, the term "director" shall mean . <br />the city's director of parks, recreation and general services. <br /> <br />Sec. 36-52. Standards for planting and replacement of trees. <br /> <br /> The following standards shall apply to the planting and <br />replacement of trees: <br /> <br /> (4) a. Trees shall be selected from those listed in the <br />"Landscape Planting and Protection Manual, Portsmouth, <br />Virginia," which may be amended as necessary by the city <br />manager or his designee. Substitutions using trees not on the <br />list may be made with the approval of the director or the <br />director's designee. No tree from the list of nonacceptabte <br />trees may be used. <br /> <br /> (6) Existing or proposed street trees planted or to be <br />planted along the street in the public right-of-way may be used <br />to satisfy the canopy coverage requirements. All trees must be <br />approved by the director or the director's designee as required <br />in subsection (7) below. <br /> <br /> (7) No landscape plan shall be approved unless the <br />director or the director's designee makes the following <br />certifications: <br /> <br /> a. All existing trees to be retained in compliance <br />with the requirements of this article are physically and <br />structurally sound; <br /> <br /> b. Where street trees are proposed, the landscape <br />plan provides for acceptable spacing, lawn area and species <br />selection in relation to streets, sidewalks, utilities, traffic <br />sight lines and parking areas. <br /> <br /> (8) No certificate of occupancy shall be issued for any <br />part of the development until the trees required by subsection <br />(1) for that part have been planted and all such trees have <br />been determined to be physically and structurally sound by the <br />director or by the director's designee. In lieu of actual <br />planting, an applicant for a certificate of occupancy may post <br />a bond or other form of security acceptable to the city <br />attorney to ensure the timely completion of the approval tree <br />planting plan. <br /> <br /> <br />
