AN ORDINANCE TO AMEND CHAPTERS 2, 16, 22, 25, AND 36 OF THE
<br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY REPEALING
<br />SECTIONS 2-341 THROUGH 2-344 AND 22-578 THEREOF, BY AMENDING
<br />SECTIONS 16-1, 16-4(b), 16-35, 16-40, 25-26 THROUGH 25-30,
<br />25-65, 25-94(b), 25-103, 25-120{b} AND (c), 25-122(c) and (d),
<br />25-128(a), (b) AND (c), 25-247 THROUGH 25-249, 36-26 AND
<br />36-52(4)a, (6),(7) AND (8) THEREOF, AND BY ENACTING A NEW
<br />SECTION 25-28.1 PERTAINING TO THE ESTABLISHMENT OF A DEPARTMENT
<br />OF PARKS, RECREATION AND GENERAL SERVICES.

<br /> BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Sections 2-341 through 2-344 AND 22-578 of the
<br />Code of the City of Portsmouth, Virginia (1988) be repealed.
<br />
<br /> 2. That Sections 16-4(b), 16-35, 16-40, 25-26 through
<br />25-30, 25-65, 25-94(b), 25-103, 25-120(b) and (c), 25-122(c)
<br />and (d), 25-128(a), (b) and (c), 25-247 through 25-249, 36-26
<br />and 36-52(4)a, (6), (7) and (8) of the Code of the City of
<br />Portsmouth, Virginia (1988) be amended and reordained to read
<br />as follows:

<br />Sec. 16-4. Littering.
<br />
<br /> (b) It shall be unlawful for any person to throw, drop or
<br />deposit on any premises or vacant property within the city any
<br />waste, including, but not limited to, refuse, garbage, trash,
<br />ashes, rubbish, building rubbish, dead animals, putrescible
<br />matter and anything injurious to health; provided, however,
<br />that the prohibition contained in this subsection shall not
<br />apply to the deposit of waste not injurious to health on a
<br />public landfill where permission to make such deposit is
<br />granted by the director of general services and done in
<br />accordance with the regulations established by the director of
<br />general services pertaining to the use of such public
<br />landfills, nor to the filling in or grading of property with
<br />earth, mud, ashes, and similar materials.

<br />Sec. 16-35. Collection of bulk refuse generally.
<br />
<br /> Bulk refuse shall be picked up from residential dwellings
<br />at such time, and in accordance with such procedures as may be
<br />established by the director of general services. Such items
<br />shall not be placed for collection as part of the regular
<br />collection process for garbage, trash or refuse. Tree branches,
<br />tree limbs, parts of trees, bushes, shrubbery and cuttings, or
<br />clippings and the like, which cannot be placed in receptacles
<br />or refuse bags as required under section 16-34(c), shall be cut
