AN ORDINANCE TO AMEND AND REORDAIN THE CODE OF THE CITY OF <br />PORTSMOUTH (1988) BY THE ENACTMENT OF SECTION 24-263, DEALING <br />WITH AGGRESSIVE PANHANDLING. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> That the Code of the City of Portsmouth (1988) is hereby <br />amended and reordained by the enactment of Section 24-263, <br />providing as follows: <br /> <br />$24-263. Aggressive panhandling. It shall be unlawful to <br />engage in aggressive panhandling. The term "aggressive <br />panhandling" requires threatening, intimidating, or harassing <br />conduct and means: (1) harassment by following and continuing <br />to insist on a gift of money from another person in a public <br />place after the initial request for money from that person has <br />been denied; (2) requesting the gift of money from another <br />person in a public place, with the request accompanied by an <br />unauthorized touching of that person; (3) requesting the gift <br />of money from another person in a public place, with the <br />request accompanied or followed by the intentional blocking or <br />interfering by any means with the person's free passage along <br />the public place; or (4) requesting the gift of money from <br />another person in a public place, with the request accompanied <br />by conduct which creates a reasonable apprehension of imminent <br />physical harm or assault. The mere requesting of a gift of <br />money in a public place without engag!ng in any of the forms of <br />threat, intimidation, or harassment see forth in this section <br />shall not be unlawful. Violation of this section shall <br />constitute a Class 1 misdemeanor. <br /> <br /> This ordinance shall take effect on the date of its <br />adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on December 9, 1997. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
