199'9--55 <br /> <br />AN ORDINANCE CLOSING AND VACATING A PORTION OF QUEEN STREET <br />EAST OF THE RIGHT-OF-WAY OF JAMESTOWN AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth and Portsmouth <br />Redevelopment and Housing Authority have made application to <br />vacate, close and discontinue the hereinafter described portion <br />of Queen Street; and <br /> <br /> WHEREAS, the Planning Commission, at a meeting held on <br />September 2, 1997 recommended approval of the closing and <br />discontinuing of said portion of Queen Street; and <br /> <br /> WHEREAS, notice of the proposed street closure has been <br />published and mailed to adjoining property owners, in <br />accordance with Section 15.1-364 of the Code of Virginia,1950, <br />as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the portion of said Queen Street <br />be closed and vacated as a public street, as follows: <br /> <br /> All that certain portion of Queen <br /> Street from its intersection with the <br /> eastern right-of-way line of Jamestown <br /> Avenue eastwardly 154.06 feet, more or <br /> less, to the point where Queen Street <br /> intersects with the western line of that <br /> portion of Queen Street closed by Ordinance <br /> Number 1995-39 of the Council of the City <br /> of Portsmouth. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth, <br />Virginia, hereby reserves unto itself a perpetual easement, <br />right and privilege to install, operate, maintain and replace <br />water mains, said easement to be fifteen (15) feet in width <br />over, under and across the portion of Queen Street hereby <br />closed, the center line of said easement to be the sixteen (16) <br />inch water main now located in Queen Street. <br /> <br /> Adopted at a meeting of the Council of the City of <br />Portsmouth, Virginia held on September 9, 1997. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
