AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-22, 40-45, <br />40-91.2(d), 40-193(b), 40-195, 40-195.1, 40-197, 40-198, AND <br />TABLES 40-43.1-1, 40-43.1-2, AND 40-44-2 THEREOF PERTAINING TO <br />ZONING. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-22 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by amending the <br />definitions of "Street" and "Street, public" contained therein <br />and by adding the definition of "Variance" thereto to read as <br />follows: <br /> <br />Sec. 40-22. Specific definitions. <br /> <br />STREET. A strip of land or way subject to vehicular traffic <br />which may also serve in part as a way for pedestrian traffic <br />and providing direct or indirect access to property, including, <br />but not limited to, roads, lanes, drives, trails, courts, <br />places, terraces, alleys, avenues, highways, boulevards, or any <br />other thoroughfare. <br /> <br />STREET, PUBLIC. An existing street or platted street dedicated <br />and accepted for the use of .the general public for all normal <br />purposes of travel, transportation or parking to which it is <br />adapted and devoted. <br /> <br />VARIANCE. A reasonable deviation from those provisions <br />regulating the size or area of a lot or parcel of land, or the <br />size, area, bulk or location of a building or structure when <br />the strict application of the ordinance would result in <br />unnecessary or unreasonable hardship to the property owner, and <br />such need for a variance would not be shared generally by other <br />properties, and provided such variance is not contrary to the <br />intended spirit and purpose of the ordinance, and would result <br />in substantial justice being done. A variance shall not <br />include a change in use which change shall be accomplished by a <br />rezoning or by a conditional zoning. <br /> <br /> 2. That the Minimum Space Requirements for Parking Group <br />1 as set forth in Section 40-45 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended to read as follows: <br /> <br />Sec. 40-45. Off-street parking requirements; parking groups. <br /> <br /> <br />
