Parking Group Minimum Space Requirements <br /> <br /> 1 1 space per attached dwelling <br /> unit; 2 spaces per detached <br /> dwelling unit. <br /> <br /> 3. That Sections 40-91.2(d), 40-193(b), 40-195, <br />40-195.1, 40-197, and 40-198 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended to read as follows: <br /> <br />Sec. 40-91.2. Action by planning director. <br /> <br />(d) When a proposed amendment involves a change in zoning <br />classification of 25 or fewer parcels of land, then, in <br />addition to the advertising as above required, written notice <br />in a manner required by the Code of Virginia shall be given by <br />the planning director at least five (5) days before the hearing <br />to the owner or owners or their agent or the occupant, of each <br />parcel involved and to the owner or owners, their agent or <br />occupants of all abutting property and property immediately <br />across the street or road from the property affected. When a <br />proposed amendment involves a change in the zoning <br />classification of more than 25 parcels of land, then, in <br />addition to the advertising as required above, written notice <br />in the manner required by the Code of Virginia shall be given <br />by the planning director at least five (5) days before the <br />hearing to the owner or owners, or their agent, of each parcel <br />of land involved. <br /> <br />Sec. 40-193. Powers and duties. <br /> <br /> (b) To authorize upon appeal or original application in <br />specific cases a variance from the terms of the zoning <br />ordinance. <br /> <br />Sec. 40-195. Variances; hardship or difficulty required. <br /> <br /> If, when owing to special conditions a literal enforcement <br />of the zoning code will result in unnecessary hardship, the <br />board of zoning appeals may authorize such variance from the <br />code as will not be contrary to the public interest; provided <br />that the spirit of the ordinance shall be observed and <br />substantial justice done. <br /> <br />A variance may be granted as follows: <br /> <br /> (a) When a property owner can show that his property was <br />acquired in good faith and where by reason of the exceptional <br /> <br /> <br />
