Failure to comply with the reporting or notification requirement as described in <br />subsection (a) constitutes a traffic infraction and shall be punishable by a fine of not more than <br />one hundred dollars ($100.00). Such failure to report shall limit the amount which may be <br />charged for the storage and safekeeping of the towed vehicle to an amount no greater than that <br />charged for one (1) day of storage and safekeeping. <br /> <br />Sec. 37-249. Assistance of police in obtaining tow truck service. <br /> <br /> Whenever it shall be necessary to procure a tow truck to render services at the scene of <br />any traffic accident or traffic hazard, any police officer present shall assist the operator or owner <br />of a distressed motor vehicle in obtaining tow truck services. Police communications facilities <br />may be used as necessary to contact tow truck operators. If the owner or operator concerned <br />requests that a specific tow truck service be called, such request shall be honored unless the <br />officer in charge determines, in his discretion, that the operator requested is located at too great a <br />distance or is otherwise actually unavailable to furnish the required services in a timely manner. <br /> <br />Sec. 37-250. Tow book to be maintained by chief of police. <br /> <br /> (a) The chief of police shall maintain a register of tow operators who shall be called <br />in sequence to provide services at the scene of accidents or traffic hazards. The book shall be <br />utilized only in those cases where the owner or operator of a distressed motor vehicle does not, <br />for any reason, provide the police officer in charge with the name of a tow operator available to <br />perform the required service in a timely manner. <br /> <br /> (b) The tow book shall be maintained and administered by the chief of police. The <br />chief of police may prescribe conditions for tow operators who apply to be included in the tow <br />book, and he may also establish rules and regulations which must be obeyed by tow operators <br />who are listed in the tow book. In promulgating such conditions, rules and regulations, the chief <br />of police may provide for the following matters: <br /> <br /> (1) Compliance with mimmum safety standards. <br /> (2) Ownership or possession of all equipment and facilities deemed necessary by the <br /> chief of police to provide essential towing services. <br /> (3) A fee schedule promulgated by the chief of police providing for the maximum <br /> fees to be charged by a tow truck operator for services rendered. Such fee <br /> schedule shall include a charge of not less than twenty-two dollars and fifty cents <br /> ($22.50) for basic towing services and additional cha~ges for necessary services in <br /> particular cases. <br /> <br /> The chief of police shall determine whether additional services were necessary in <br />each particular case and approve all fees charged therefor as follows: <br /> <br /> 23 <br /> <br /> <br />
