Sec. 37-106. Records. <br /> <br /> There shall be kept in the office of the chief of police or such other place as the chief of <br />police may designate, a complete record of all public vehicle driver's permits issued under this <br />division and of all renewals, suspensions and revocations thereof. <br /> <br />Sec. 37-107. Collection and disposition of fees prescribed by division. <br /> <br /> The fees prescribed by this division shall be collected by the chief of police and paid over <br />to the city treasurer to be used as provided by law. <br /> <br />Sec. 37-108. Board of appeal for hearing appeals from revocation or suspension of public <br />vehicle driver's permit - Established; composition; appointment of members; etc. <br /> <br /> For the purpose of hearing appeals as provided for in section 37-109, there is hereby <br />established a board to be called the "Public Vehicle Board of Appeals". The board shall consist of <br />five members and shall be composed of one member from the City Convention and Visitors <br />Bureau, one from the City Commissioner of Revenue Office, one from the City Traffic <br />Engineering Office, one from the City Personnel Office, and one member who shall be a <br />representative of those persons holding a public vehicle driver's permit, hereinafter referred to as <br />the taxicab drivers. <br /> <br /> Each member of the board shall be appointed at random by the City Manager. The <br />members of the board shall be appointed for terms of twelve (12) months. No member of the <br />board of appeal shall serve more than one (1) term in any five (5) year period. Vacancies shall <br />be filled for any unexpired term in the manner in which original appointments are made. The <br />member from the City Convention and Visitors Bureau shall serve as chairperson of the board. <br /> <br /> The board shall abide by the guidelines established in the Public Vehicle Board of <br />Appeals Operational Manual. Three (3) concurring votes shall be necessary for a decision by <br />the board of appeal at any meeting of the board. Three (3) members shall constitute a quorum of <br />the board of appeal. <br /> <br />Sec. 37-109. Same - Appeals to board. <br /> <br /> (a) Whenever it is the decision of the chief of police that the public vehicle driver's <br />permit or a certificate of public convenience and necessity should be suspended or revoked for <br />good cause shown, the person whose permit or certificate has been suspended or revoked may <br />appeal the decision of the chief of police to the board of appeal. Notice of appeal shall be in <br />writing and filed with the chief of police within ten (10) days after the initial decision of the chief <br />of police. The chief of police shall forward the notice of appeal, along with a copy of his or her <br />decision and all papers pertaining thereto to the board within five (5) business days after <br />receiving the notice of appeal. <br /> <br /> 16 <br /> <br /> <br />
