required by this Code or state law. <br /> (b) No public vehicle owner shall permit such vehicle to be driven by any person who <br /> does nol possess the permit required by this section. <br /> (c) A violation of this section shall be punished as a Class 3 misdemeanor. Every <br /> subsequent conviction of a violation thereof within five (5) years of a previous <br /> conviction shall be punished as a Class 2 misdememmr. <br /> <br />Sec. 37-92. Application. <br /> <br /> Application for a perrmt required by this division shall be in writing, sworn to and <br />presented to the chief of police and shall state the full name, current residence, place(s) of <br />residence for the previous ten (10) years prior to moving to the applicant's present address, age, <br />height, color, color of eyes and hair, sex, place of birth, public vehicle employer for which the <br />applicant will be driving, name and address of any other place of employment at time of <br />application, length of residence in the city, whether or not the applicant is a citizen of the United <br />States, whether or not the applicant has been previously employed or licensed as a public vehicle <br />driver, and if so, whether the applicant's driver's license or public vehicle driver's permit has <br />ever been suspended, revoked, or refused in this or any other state, whether or not the applicant <br />is addicted to the use of intoxicating liquors or drugs, and such other information as may be <br />required. The application shall be endorsed by the prospective employer of the applicant. Any <br />false statement made in any such affidavit shall be promptly reported by the chief of police to the <br />commonwealth's attorney. <br /> <br />See. 37-93. Investigation of applicant. <br /> <br /> Upon the filing of an application for a public vehicle driver's permit under this division, <br />the chief of police shall cause to be made such examination as he may deem proper relating to <br />the qualifications and fitness of the applicant to operate a public vehicle in accordance with the <br />provisions of Sec. 37-101. <br /> <br />Sec. 37-94. Photographs of applicant, <br /> <br /> The applicant shall provide two (2) color passport-size photographs of the applicant at the <br />time of application. One photograph shall be filed with the chief of police and the other shall be <br />made a part of the permit in such manner that it cannot be removed and another photograph <br />substituted without detection. <br /> <br />Sec. 37-95. Issuance or refusal; fee. <br /> <br /> If the chief of police shall determine that any applicant is of the age of eighteen (18) years <br />or older, not addicted to the use of intoxicating liquors or drugs, morally fit and having <br />knowledge of the traffic laws of the state and city, the chief of police, upon the applicant's <br />payment of a fee of fifteen dollars ($15.00), shall issue to such applicant a public vehicle driver's <br />permit.
