misdemeanor. <br /> <br />Sec. 37-36. Drivers bearing evidence of intoxicating beverages. <br /> <br /> No driver of a public vehicle shall operate a vehicle for hire with any evidence of <br />intoxicating beverages on his person or upon his breath. Any person who violates or fails to <br />comply with the provisions of this section shall be guilty of a Class 1 misdemeanor. <br /> <br />Sec. 37-37. Driver's manifest. <br /> <br /> Each taxicab owner or operator shall furnish the driver with a driver's manifest on a form <br />approved by the chief of police, which form shall have spaces provided for a record of the <br />following: <br /> <br /> (1) Owner's and operator's name(s). <br /> <br /> (2) Driver's name. <br /> <br /> (3) Date and time driver begins duty. <br /> <br /> (4) Number of trips on the taximeter at the start of the day. <br /> <br /> (5) Starting point, finishing point and time of each trip. <br /> <br /> (6) Additional fees and total amount charged to the passenger(s), including toll(s). <br /> <br /> No owner shall permit a taxicab driver who comes on duty. to drive unless he has the <br />manifest in the vehicle. At the beginning of a shift or when he or she comes on duty, the driver <br />shall record in the manifest the time of beginning the shift or going on duty and the odometer <br />reading of the taxicab, before any passenger is transported as a fare. At the conclusion of a shift <br />or upon going off duty, the driver shall record the shift end time, units, and trips, as shown on the <br />taximeter at that time. <br /> <br /> At the beginning of each call or trip made, the driver shall record on the manifest the time <br />of beginning the call or trip and the place where the fare is picked up. At the end of the call or <br />trip, the driver shall record the time of ending and the place where the fare is discharged. The fare <br />collected for each call or trip shall be recorded immediately after collection. The manifest shall <br />be delivered to the owner at the termination of each driver's assignment. <br /> <br /> The manifest shall be retained by the owner for a period of thirty (30) days. The manifest <br /> shall be open for inspection at all reasonable times by the chief of police or his or her designee. <br /> <br /> <br />
