R-98-38 <br /> <br />A RESOLUTION AUTHORIZING A LONG-TERM LEASE AGREEMENT WITH THE <br />HOFFLER CREEK WILDLIFE FOUNDATION. <br /> <br /> WHEREAS the City has previously entered into a one-year lease with the Hoffler Creek <br />Wildlife Foundation (the "Foundation") for a 142-acre tract of woodlands, wetlands, and a <br />borrow pit (the "Property") located generally along Twin Pines Road close to its intersection with <br />River Shore Drive, with this lease being for the purpose of developing a credible plan of action <br />for the Property; and <br /> <br /> WHEREAS the Foundation has, during the course of its lease with the City, met all <br />preliminary performance requirements of the City with regard to funding and long-term <br />planning, and the City has determined that it is in the public interest to lease the Property to the <br />Foundation for a longer period of time so that the Foundation can proceed with its master plan of <br />developing the property as a nature and wildlife preserve and/or conservation area open to the <br />public; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the City Manager is authorized, for and on behalf of the City, to enter into an <br />agreement with the Foundation substantially in conformity with the attached "Long-Term Lease <br />Agreement." The Manager is further authorized to take such other actions as may be necessary <br />to implement said Agreement, subject to any legally required approvals of Council. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />September 22, 1998. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
