ORDINANCE NO. 22. <br /> <br />AN ORDINANCE CLOSING AND VACATING A PORTION OF WILLIAMSBURG <br />AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth, Virginia has made application to close a portion of <br />Williamsburg Avenue, as hereafter described; and <br /> <br /> WHEREAS, the Planning Commission, at a meeting held on June 6, 2000, <br />recommended approval of the closure and vacation of said portion of Williamsburg Avenue; and <br /> <br /> WHERAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that the of Wlliamsburg Avenue be closed and vacated as a public street and right of <br />way as follows: <br /> <br /> All that certain portion of Williamsburg Avenue, being situate in the City of <br />Portsmouth, Virginia, said portion lying between the south right of way line of King Street and <br />the north right of way line of County Street. <br /> <br /> BE IT FURTFIER ORDAINED that a perpetual easement is hereby reserved unto the <br />City of Portsmouth in that portion of Williamsburg Avenue hereby closed and vacated for the <br />installation, operation, maintenance and replacement of utilities owned and operated by the City <br />of Portsmouth and private utilities, which said easement may be closed and vacated by the City <br />Manager as he may in his discretion deem appropriate, and in the best interest of the City of <br />Portsmouth. <br /> <br /> BE IT FURTHER ORDAINED that the City manager is hereby authorized to make and <br />execute such deeds of conveyance or other documents as may be necessary and appropriate to <br />give effect to the vacation and closure implemented by this ordinance. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on June <br />13, 2000. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
