AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLE 40-43.1-2 AND <br />SECTION 40-34.4 THEREOF PERTAINING TO WEDDING CHAPELS AND <br />TABLE 40-44-2 THEREOF PERTAINING TO ACCESSORY STRUCTURES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-34.4 of the Code of the City of Portsmouth, Virginia be <br />amended by adding thereto Condition 11 to read as follows: <br /> <br />Sec. 40-43.4. Conditions for Specific Uses. <br /> <br /> (11) A wedding chapel is a place of for-profit business where the performance <br />of wedding ceremonies for a fee is the principal business. A wedding chapel may include <br />accessory space for taking commemorative photographs. It may also include accessory <br />space for a reception associated with a specific wedding conducted in the wedding <br />chapel. No f'inancial collections may be taken except as an integral part of a wedding. <br />No regularly-scheduled meetings of a religious nature may take place in the <br />establishment unless permitted by a use permit issued for "Religious organizations" <br />(S.I.C. 8661 ). <br /> <br /> 2. That Table 40-43.1-2 of the Code of the City of Portsmouth, Virginia, be <br />amended to permit the use "Wedding chapel" (Standard Industrial Classification No. <br />7299) in the Commercial C-I and Commercial C-2 zoning districts upon issuance of a <br />use permit, subject to the requirements of Condition 11 and Parking Group 8. <br /> <br /> 3. That Table 4043.1-2 of the Code of the City of Portsmouth, Virginia, be <br />amended to permit the use "Re-upholstery and furniture repair" (Standard Industrial <br />Classification No. 7641) in the Office Residential OR-75 zoning district upon issuance of <br />a use permit and in the Commemial C-l, Commercial C-2, and Industrial M-I zoning <br />districts, all subject to the requirements of Parking Group 13. <br /> <br /> 4. That Table 40-44-2 of the Code of the City of Portsmouth, Virginia be <br />amended to add Note "h" to read as follows: <br /> <br /> h = Placement of accessory structures in a front yard is prohibited in all residential <br />zoning districts. <br /> <br />2.
