AN ORDINANCE CLOSING AND VACATING THE EASTERN THIRTY (30) FEET OF RUTH BROWN AVENUE (FORMERLY SECOND STREET), LOCATED SOUTH OF THE SOUTH RIGHT OF WAY LINE OF WYTHE STREET AND NORTH OF THE NORTH RIGHT OF WAY LINE OF WAVY STREET, IF EXTENDED EASTWARDLY ACROSS RUTH BROWN AVENUE. WHEREAS, the City of Portsmouth and the Commonwealth of Virginia (Virginia Department of Transportation) have made application to close a portion of Ruth Brown Avenue (formerly Second Street) lying east of the center line of Ruth Brown Avenue, south of the south right of way line of Wythe Street and north of the north right of way line of Wavy Street, if extended eastwardly across Ruth Brown Avenue; and WHEREAS, the Planning Commission of the City of Portsmouttb at a meeting held on April 4, 2000, recommended approval of the closing and vacating of said street; and WHEREAS, notice of closure has been given adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, 1950, as amended. WHEREAS, the Council of the City of Portsmouth has determined that closure of the eastern 30 feet of that portion of Ruth Brown Avenue should be approved. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that a portion of Ruth Brown Avenue be closed and vacated as a public street and right of way, as follows, to-wit: All that certain portion of Ruth Brown Avenue (formerly Second Street) located and being in the City of Portsmouth, Virginia, said portion being the eastern 30 feet of Ruth Brown Avenue located south of the south right of way line of Wythe Street and north of the north right of way line of Wavy Street, if extended eastwardly across Ruth Brown Avenue Adopted by the Council of the City of Portsmouth, Virginia at a meeting held on April 25, 2000.
