(2) Side or Rear Yards- A fence or wall shall not exceed eight feet in <br />height in a side or rear yard. For purposes of this section, a side <br />yard is deemed to begin at the building line established by the front <br />edge of the principal dwelling on the lot. <br /> <br />(3) Height Exception - The capital of a fence post or column may <br />extend up to two feet above the maximum height limit, <br /> <br />(4) Rights-of-Way - No fence or wall shall be constructed within <br />any public right-of-way. <br /> <br />(5) Visibility - Where visibility by drivers of motor vehicles is or will <br />be obstructed by a fence or wall, the City Traffic Engineer may <br />require a reduction in height or an increase in the setback of that <br />structure. <br /> <br /> (b) The Planning Commission may authorize a fence or wall that exceeds the <br />above height linfitations by up to 25%, if the Commission finds that the following <br />conditions exist: <br /> <br />(1) The fence or wall does not impede the natural light from reaching <br />the subject or surrounding properties. <br /> <br />(2) The fence or wall will not hinder the provision of emergency <br />services to the subject or surrounding properties. <br /> <br />(3) The fence or wall will not be of substantial detr'nuent to adjacent <br />property, and the character of the neighborhopd will not be <br />changed. <br /> <br />(4) Visibility for pedestrian and vehicular traffic will not be impeded. <br /> <br />(5) The fence does not encroach into any public right-of-way. <br /> <br /> 3. That Section 32-29 of the Code of the City of Portsmouth, Virg'mia, is <br />hereby repealed and that there is adopted a new Section 40-44.5.1 to read as follows: <br /> <br />Sec. 40-44.5.1 Barbed or razorwire. <br /> <br /> (a) No barbed or razor wire shall be used for the purpose of wholly or <br />partially enclosing any lot or premises, except that barbed ends of fences, barbed wire <br />and razor wire may be used on top of any wall or fence wholly or partially enclosing any <br />lot or premises in any commercial or industrial district, as defined by zoning ordinance, <br />and barbed wire may be used on top of any wall or fence wholly or partially enclosing <br />any public school, park. recreational or playground site in any residential, commercial or <br />industrial district; provided, that such wail or fence is at least six feet in height, that the <br /> <br /> <br />
