AN ORDINANCE TO AMEND CHAPTERS 32 AND 40 OF THE, CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40- <br />44.4(a), BY ADOPTING NEW SECTIONS 40-44.5 AND 40-44.5.1, AND BY <br />REPEALING SECTION 32-29 PERTAINING TO FENCES AND WALLS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-44.4(a) of the Code of the City of Portsmouth, Virginia <br />(1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-44.4. Measurements and computations. <br /> <br /> In applying the dimensional requirements, the following principles shall be <br />applied: <br /> <br /> (a) Permitted encroachments on yards. The following architectural features <br /> may encroach upon the yard setback area, provided that the rest of the <br /> building does not so encroach: <br /> <br /> (1) Architectural features: cornices, eaves, gutters, bay windows less <br /> than ten feet wide, carports, fire escapes, fire balconies, fire <br /> towers, eaves, gutters and similar fixtures, may project not more <br /> than 2 1/2 feet into any required yard; <br /> <br /> (2) Retaining walls and fences: Retaining wails and fences shall be <br /> exempt from yard and building setback requirements except as <br /> otherwise specified; <br /> <br /> (3) Terraces and porches: Terraces, steps and uncovered porches <br /> which are not in any part more than four feet above ground level <br /> and not within 2 1/2 feet of any property line shall be otherwise <br /> exempt from the yard and building setback requirements. <br /> <br /> 2. That there is hereby adopted a new Section 40-44.5 of the Code of the <br />City of Portsmouth, Virginia (1988) to read as follows: <br /> <br />See. 40-44.5. Fences and walls; dimensional requirements. <br /> <br /> (a) Subject to the comer visibility restrictions contained in Section 40-44. I (c), <br />the following dimensional requirements shall apply to all fences and walls located on any <br />property in a residential zoning district: <br /> <br /> (1) Front Yard- A fence or wall shall not exceed four feet in height in <br /> a front yard. <br /> <br /> <br />
