AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF TIlE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-43.6 AND 40- <br />162.1 THEREOF PERTAINING TO PUBLIC STREET ACCESS AND TO <br />NONCONFORMING ZONE LOTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> I. That Sections 40-43.6 and 40-162.1 of the Code of the City of Portsmouth, <br />Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-43.6. Same--Street access requirements. <br /> <br /> No structure shall be erected on any lot that does not abut a public street as <br />defined in section 40-22 except that a structure may be erected on a platted lot or parcel <br />that is part ora subdivision exempt from subdivision review requirements under Section <br />33-2. Except as permitted under Section 33-2, no building or other permit shall be issued <br />for a proposed commercial or industrial use otherwise permitted by this chapter unless <br />such building or use will be located on a zone lot which abuts a street that is fully <br />improved to standards set by the subdivision ordinance as in effect on the date of the <br />permit application. For the purposes of determining compliance with this section, a zone <br />lot will be considered to abut a street fully improved to the standards of the subdivision <br />ordinance if that portion of the street abutting the lot and extending to the centerline of <br />the street right-of-way complies with the standards of the subdivision ordinance. <br /> <br />Sec. 40-162.1 Lot merger. <br /> <br /> In order to minimize the number of nonconforming zone lots, if two (2) or more <br />adjoining lots or parcels with continuous frontage on a public street are in a single <br />ownership and if either or any of such lots or parcels individually are mo small in any <br />dimension to meet the yard, Width and lot area requirements of the district in which they <br />are located, then such group of lots or parcels shall be considered as a single zone lot or <br />several zone lots of such size as is necessary to meet the minimum dimensional <br />requirements of the district. <br /> <br />2.
