October 28, 1986 At a special meeting of the City Council held on Tuesday, )ctober 28, 1986, there were oresent: James W. Holley, III, J. Robert Gray, L. Louise Lucas, J. Herbert Simpson, Gloria O. Webb, George L. Hanbury, City Manager, Steven Lieberman, City Attorney. Absent: Jack P. Barnes, E. G. Corprew, Jr. 86-381 - The £9~tgwing call for-the ~eeting~was read: "Please attend a special meeting of the City Council to be hel in the Council Chamber, 6th floor of City Hall, 801 Crawford Street at 4:30 p.m. on Tuesday, October 28, 1986, for the purpose of a ~ublic work session on an appeal from the Commission of Architectur In addition, you may consider a motion to go into an executive sesslon. By order of the Mayor." 86-382 A public work session was held for an appeal from and Mrs. Martin Bright regarding a decision of the Commission of Architectural Review for Pert Norfolk and Park View made on October 6, 1986 concerning 6S5 Florida Avenue. Ernest Freeman, City Planner, made a presentation. Kathleen Bright made a presentation. (See Exhibit 86-382 Councilman Corprew arrived for the public work session at 4:54 Motion of Mrs. Lucas and seconded by Mrs. Webb, as follows: "The City Council recognizes that a hardship has been placed upon the Brights based upon their reliance upon the prior policy of the Commission of Architectural Review which allowed the covering of facia, soffits and eaves with vinyl and/or aluminum. This prior policy was explaned to the Brights in June 1.of 1985 by the City Planning staff. The Brights proceeded to obtain financing and con- tracted to have the whole house covered in reliance on this June, 1985 expl~natiio~ of the Commission's policy in effect at that time. In recognition of this hardship, the Council of the City of Portsmouth by a 6-0 vote overturns the Commission of Architectural Review's decision of October 6, 1986 and allows the Brights to cove~ the soffit, eave and trim areas with vinyl or aluminum." As stated above the motion was adopted by 6-0 vote. 86-383 - Motion of Mr. Gray and seconded by Mrs. Lucas, to go into an executive session in accordance with Section 2.1-344 of the Code of Virginia to discuss the following: 1. The condition, acqusition and use of real property for purposes as permitted under subsection (a) (2); 2. Consultation with City embers pertaining to actual or ~atters within the jurisdiction subsection (a) (6); Attorney and briefing by sta~[ potential litigation or other legal of City Council as permitted under On motion was adopted by 6-0 vote.
