<br /> Robert C. and Ruth Jacobs have made application to vacate and close a portion of a
<br />12 1/2 foot alley extending from the north side of Franklin Avenue to the south side of
<br />Edison Avenue. Council adopted a resolution appointing viewers on November 1, 1978. Said
<br />viewers have reported that no inconvenience would result from
<br />The City Manager recommends adoption."

<br />R~ver Shore Road and Southampton Arch.

<br />N N.H. and Jean Moste]ler petitioned to close a portion of Raintr~e Lane betwee~
<br />River Shore Road and Southampton Arch. A resolution appointing viewers was adopted by
<br />Council on May 9, 1978. The viewers reported in writing that in their opinion no
<br />ience would result from the closing of said street. A copy of the viewers report
<br />for your information. The City Manager recommends adoption."

<br /> 78-419 "Consideration of a resolution providing for the acquisition of certain
<br />property under eminent domain proceedings, said property being necessary for the construction
<br />maintenance and operation of port facilities.
<br />
<br /> The City of Portsmouth has found it necessary to acquire certain property for the
<br />purpose of constructing, operating and maintaining port facilities. The City has not been
<br />able to purchase said property because the owner and the City have not been able to agree
<br />on the price. The advancement of the work and use of said property will be delayed unreason-
<br />ably if said property is not made available as soon as possible. This resolution directs
<br />the City Attorney to commence eminent domain proceedings in order to acquire the necessary
<br />property. The City Manager recommends adoption."

<br /> On motion of Mr. Early and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the following vote:

<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE
<br /> CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT
<br /> TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING
<br /> NECESSARY FOR THE CONS%RUCTION, MAINTENANCE AND OPERATION OF PORT FACILITIES,
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinaftc
<br />specified in and to the hereinafter described parcel of land, situate in the City of Portsmoul
<br />Virginia, for the purpose of constructing, operating and maintaining port facilities; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project, because the owner thereof and the City have not been able
<br />to agree upon the price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and the use of said property will be delayed unreasonab]
<br />if said property is not made available as soon as possible.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Attorney be, and he hereby is, directed to institute eminent domain proceedings
<br />against the following described property, situate in the City of Portsmouth, Virginia, for
<br />the purpose of acquiring fee simple title thereto, together with any and all easements of
<br />access, light or air incident to the lands of the landowner abutting upon said nroperty in
<br />accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of ~he City of
<br />Portsmouth (Chapter 471 of the Acts of Assembly, 1970, as amended), and to deposit to the
<br />credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law the
<br />sum hereinafter specified to compensate the owner of the parcel of land described as follows,
<br />to-wit:

<br /> Ail those certain lots, pieces or parcels of land, situate in the City
<br />of Portsmouth, Virginia, known, numbered and designated as Lot 109 on the
<br />plat of Pinners Point Land Company, recorded in the Clerk's Office of the
<br />Circuit Court of the City'of Chesapeake, Virginia, in Map Book 4, Page 7.
